Terms of Service

1. Agreement to these terms

By downloading, installing, or using the Phew app (“Phew”, “the app”, “the service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the app.

These Terms form a binding agreement between you and Creative Code Logic Ltd (“we”, “us”, “our”). Our Privacy Policy is incorporated into these Terms by reference.

2. Eligibility

You must be at least 16 years old to use Phew. By creating an account, you confirm that you meet this requirement. If you are under 16, you may not use the app. We will delete accounts belonging to users under 16 if we become aware of them — see our Privacy Policy for how to report this.

3. What Phew is

Phew is a mobile app that helps couples remember dates and moments that matter — birthdays, anniversaries, reservations, appointments, and anything else worth keeping. You can link with one partner as a “pair”, create and share moments, and receive reminders ahead of events.

Phew is available on Android (Google Play) and iOS (Apple App Store). Phew is currently free to use — there are no subscriptions or in-app purchases.

4. Important limitation — reminders are an aid, not a guarantee

Phew is a helpful aid, not a guaranteed alert system.

Push notifications and emails are delivered by third-party platform services (Google, Apple, email providers) and depend on factors outside our control — your device settings, network connectivity, app permissions, and the reliability of those services. We cannot guarantee that every reminder will be delivered on time, or delivered at all.

Do not rely on Phew as your sole reminder for critical events — medical appointments, legal deadlines, flight check-ins, or anything where a missed notification could cause serious harm. Always keep a backup reminder using your device’s built-in calendar or another system.

5. Your account

You are responsible for keeping your login credentials secure. Do not share your password. You are responsible for all activity that takes place under your account.

Notify us immediately at admin@creativecodelogic.com if you believe your account has been compromised.

6. Acceptable use

You agree to use Phew lawfully and in good faith. You must not:

• Use the app to harass, abuse, stalk, or otherwise harm your partner or any other person.
• Upload or store content that is unlawful, obscene, defamatory, or that infringes any third party’s intellectual property rights (in moment titles, notes, or any other field).
• Attempt to reverse engineer, decompile, or extract the source code of the app.
• Attempt to gain unauthorised access to our systems or another user’s account.
• Use the app in any way that violates applicable law or regulation.
• Use the app to distribute spam or unsolicited communications.

We may remove content or accounts that breach these rules.

7. Your content

You own your moments. The titles, notes, dates, and other content you create (“Your Content”) remain yours.

By using Phew, you grant us a limited, non-exclusive, royalty-free licence to store, display, and transmit Your Content solely to operate the service — that is, to show your moments to you and your linked partner, and to send you reminders about them. We do not use Your Content for any other purpose.

When you delete your account, your content is deleted as described in our Privacy Policy (subject to the 30-day grace period). Moments created by your partner remain theirs and are not affected by your deletion.

8. Account termination

By you: You may delete your account at any time from Settings → Your data → Delete account. See the Privacy Policy for the deletion timeline.

By us: We may suspend or terminate your account if we reasonably believe you have materially breached these Terms, including (but not limited to) the acceptable-use rules in Section 6. We will try to give you notice, but we may act without notice in cases of serious harm or legal obligation.

9. The service is provided “as is”

To the maximum extent permitted by applicable law:

• The service is provided “as is” and “as available” without warranties of any kind, express or implied.
• We make no warranty that the service will be uninterrupted, error-free, or free of security vulnerabilities.
• We do not warrant that reminders will be delivered on time or at all (see Section 4).

Nothing in these Terms affects your statutory rights as a consumer where those rights cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law:

• We will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the service.
• In particular, we are not liable for missed events, missed appointments, or any harm resulting from a notification that was delayed or not delivered.
• Phew is provided free of charge. Our total aggregate liability to you for any claim arising out of or related to these Terms or the service is capped at £50 (or the equivalent in your local currency).

11. Indemnity

You agree to indemnify and hold harmless Creative Code Logic Ltd and its officers, employees, and agents from any claims, damages, and costs (including reasonable legal fees) arising from: (a) your use of the service in breach of these Terms; (b) Your Content; or (c) your violation of any applicable law.

12. Changes to the service and these Terms

We may update or discontinue features of Phew at any time. If we make material changes to these Terms, we will notify you by email or by a notice in the app at least 14 days before they take effect (or sooner if required by law or to address a security concern). Continuing to use the service after that date means you accept the updated Terms.

If you do not accept updated Terms, you may delete your account before the changes take effect.

13. Governing law and disputes

These Terms are governed by the laws of England & Wales. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of England & Wales.

We hope any issue can be resolved by contacting us first — please email admin@creativecodelogic.com before initiating legal proceedings.

14. General

App stores. Your download and use of Phew is also subject to the terms of the app store you obtained it from (Google Play or, on iOS, the Apple App Store). For matters specific to that store, the store’s terms govern. (Apple-specific terms, including Apple’s status as a third-party beneficiary, will apply to the iOS version when it is released.)

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms. We may assign them to a successor (for example, in a merger or acquisition).
